The Royal Dutch Medical Association recently completed a researchproject aimed at investigating how guidelines for `appropriatemedical care' should be construed. The project took as a startingpoint that explicit attention should be given to ethical andpolitical considerations in addition to data about costs andeffectiveness. In the project, two research groups set out todesign guidelines and cost-effectiveness analyses (CEAs) for twocircumscribed medical areas (angina pectoris and majordepression). Our third group was responsible for the normativeanalysis. We undertook an explorative, qualitative pilot study ofthe (...) normative considerations that played a role in constructingthe guidelines and CEAs, and simultaneously interviewedspecialists about the normative considerations that guided theirdiagnostic and treatment decisions. Explicating normativeconsiderations, we argue, is important democratically: the issuesat stake should not be left to decision analysts and guidelinedevelopers to decide. Moreover, it is a necessary condition for asuccessful implementation of such tools: those who draw uponthese tools will only accept them when they can recognizethemselves in the considerations implied. Empirical normativeanalysis, we argue, is a crucial tool in developing guidelinesfor appropriate medical care. (shrink)

The Leibniz Center for Law is involved in the project Digitale Uitwisseling Ruimtelijke Plannen [DURP (http://www.vrom.nl/durp); digital exchange of spatial plans] which develops a XML-based digital exchange format for spatial regulations. Involvement in the DURP project offers new possibilities to study a legal area that hasn’t yet been studied to the extent it deserves in the field of Computer Science & Law. We studied and criticised the work of the DURP project and the Dutch Ministry of internal affairs on metadata (...) for regulatory documents, and made an inventory of issues related to legal knowledge representation that it felt were not sufficiently covered by current initiatives in the Geographic Information Systems (GIS) field. This inventory was an input to the DURP standardisation effort. In a second phase of the project we extended the METALex XML schema (cf. Boer et al. 2002; Boer et al. 2003) for ‚regular’ legal sources that we developed in the past for geospatial regulatory information, in order to support exchange of spatial regulations, including the associated geospatial information in the form of maps. We developed a prototype application and demonstrated how the spatial planning information in GML can be combined with XML with only minimal changes, using the Web Ontology Language (OWL). A questionnaire survey was conducted with 1509 nurses who were employed in hospitals, home care organizations and nursing homes. The study was conducted in the Netherlands between January 2001 and August 2004. The results show that less than half (45%) of nurses would be willing to serve on committees reviewing cases of euthanasia and physician-assisted suicide. More than half of the nurses (58.2%) (...) found it too far-reaching to oblige physicians to consult a nurse in the decision-making process. The majority of the nurses stated that preparing euthanatics (62.9%) and inserting an infusion needle to administer the euthanatics (54.1%) should not be accepted as nursing tasks. The findings are discussed in the context of common practices and policies in the Netherlands, and a recommendation is made not to include these three issues in new regulations on the role of nurses in euthanasia and physician-assisted suicide. This article presents an analysis of Turkish film screenings in Belgium as a case study of diasporic media practices in Europe. Turkish blockbusters have only recently become part of the programs of Belgian mainstream film theaters. This study provides insight into both historical and recent dynamics that characterize this new film and audience segment in film exhibition. After analyzing transnational patterns of distribution, selection and promotion, we put forward that changing circulation patterns and the associated power relations define the social (...) and spatial conditions of reception, resulting in the creation of new semi-public diasporic spaces. Thus, the links between the political economy of media and audience research are discussed. The findings of this article are based on archival and press research and a series of semi-structured expert interviews with exhibition and distribution professionals, as well as social workers and representatives from Turkish cultural associations. Recent developments in agriculture have stirred up interest in the concept of “sustainable” farming systems. Still it is difficult to determine the extent to which certain agricultural practices can be considered sustainable or not. Aiming at identifying the necessary attributes with respect to sustainability in Dutch dairy farming in the beginning of the third millennium, we first compiled a list of attributes referring to all farming activities with their related side effects with respect to economic, internal social, external social, and (...) ecological sustainability. A wide range of people (i.e., experts and stakeholders) were consulted to contribute to our list of attributes. Our consultation showed that only one attribute was selected for economic and internal social sustainability: profitability and working conditions, respectively. The list for external social sustainability contained 19 attributes and the list for ecological sustainability contained 15 attributes. To assess their relative importance, the same experts and stakeholders ranked the attributes for external social and ecological sustainability by using a questionnaire. The most important attributes for external social sustainability were food safety, animal health, animal welfare, landscape quality, and cattle grazing. For ecological sustainability they were eutrophication, groundwater pollution, dehydration of the soil, acidification, and biodiversity. The present method for identifying and ranking attributes is universal and, therefore, can be used for other agricultural sectors, for other countries, and for other time periods. (shrink)

A symmetric network consists of a set of positions and a set of bilateral links between these positions. For every symmetric network we define a cooperative transferable utility game that measures the “power” of each coalition of positions in the network. Applying the Shapley value to this game yields a network power measure, the β-measure, which reflects the power of the individual positions in the network. Applying this power distribution method iteratively yields a limit distribution, which turns out to be (...) proportional to the well-known degree measure. We compare the β-measure and degree measure by providing characterizations, which differ only in the normalization that is used. (shrink)

In this paper a framework to study consciousness in animals is proposed which is based on a hierarchical organizational feedback model of the central nervous system, the separation of a given mental state into two components, i.e. an invariant part, and a variant part, which are separately related to the organization of the central nervous system, i.e. 'a neural network' and 'momentary active connections within the neural network determined by in- and output of this neural network' respectively, and phylogeny based (...) on the invariant part or the presence of a neural network. Consciousness is defined as a property of neural networks of self-organizing systems dedicated to dealing with rapidly changing environments affording flexibility of behavioural patterning. (shrink)

A comparison between the Prolegomena of Chapter II of De iure praedae and the Prolegomena of De iure belli ac pacis leads to the conclusion that the ideas of Grotius on legal systematization have changed considerably between 1604 and 1625. Whereas Grotius starts in IPC with general principles with a rather unclear distinction between leges and regulae, in IBP he gives first the philosophical and theological basis of international law, intertwined by a concise set of general legal rules, mostly derived (...) from Roman law after its reception in Western Europe. The general outlines of legal systematization in the early-modern period are expounded. In the attempts of legal systematization the concept of subjective rights is essential. These subjective rights are not, as is sometimes assumed, a medieval renewal of legal technique, but can be found essentially already in classical Roman law of the first centuries AD.The institutional system is not yet visible in De iure praedae, it might be different for De iure belli ac pacis. Significant here are possibly the expressions ius ad bellum and ius in bello. (shrink)

Transcranial direct current stimulation over the contralateral primary motor cortex of the target muscle has been described to enhance corticospinal excitability, as measured with transcranial magnetic stimulation. Recently, tDCS targeting the brain regions functionally connected to the contralateral primary motor cortex was reported to enhance corticospinal excitability more than conventional tDCS. We compared the effects of motor network tDCS, 2 mA conventional tDCS, and sham tDCS on corticospinal excitability in 21 healthy participants in a randomized, single-blind within-subject study design. We (...) applied tDCS for 12 min and measured corticospinal excitability with TMS before tDCS and at 0, 15, 30, 45, and 60 min after tDCS. Statistical analysis showed that neither motor network tDCS nor conventional tDCS significantly increased corticospinal excitability relative to sham stimulation. Furthermore, the results did not provide evidence for superiority of motor network tDCS over conventional tDCS. Motor network tDCS seems equally susceptible to the sources of intersubject and intrasubject variability previously observed in response to conventional tDCS. (shrink)

Humans are experts in cooperating with each other when trying to accomplish tasks they cannot achieve alone. Recent studies of joint action have shown that when performing tasks together people strongly rely on the neurocognitive mechanisms that they also use when performing actions individually, that is, they predict the consequences of their co‐actor’s behavior through internal action simulation. Context‐sensitive action monitoring and action selection processes, however, are relatively underrated but crucial ingredients of joint action. In the present paper, we try (...) to correct the somewhat simplified view on joint action by reviewing recent studies of joint action simulation, monitoring, and selection while emphasizing the intricate interrelationships between these processes. We complement our review by defining the contours of a neurologically plausible computational framework of joint action. (shrink)

Increasing public concern for the welfare of fish species that human beings use and exploit has highlighted the need for better understanding of the cognitive status of fish and of their ability to experience negative emotions such as pain and fear. Moreover, studying emotion and cognition in fish species broadens our scientific understanding of how emotion and cognition are represented in the central nervous system and what kind of role they play in the organization of behavior. For instance, on a (...) macro neuro-architecture level the brains of fish species look dramatically different from those of mammals, while such a dramatic difference does not (always) occur at the level of emotion- and cognition-related behavior. Here, therefore, we discuss the evidence of emotion and cognition in fish species related to underlying neuro-architecture and the role that emotion and cognition play in the organization of behavior. To do so we use a framework encompassing a number of steps allowing a systematic approach to these issues. Emotion and cognition confer on human and non-human animals the capacity to compliment and/or override immediate reflexes to stimuli and so allow a large degree of flexibility in behavior. Systematic research on behavior that in mammals is indicative of emotion and cognition has been conducted in only a few fish species. The data thus far indicate that in these species brain-behavior relationships are not fundamentally different from those observed in mammals. Furthermore, data from other studies show evidence that behavior patterns related to emotion and cognition vary between fish species as well within fish species, related to sex and life history stage for example. From a welfare perspective, knowledge of such variability will potentially help us to design optimal living conditions for fish species kept by humans. (shrink)

Genderism and Realism. A Reading of Émile Zola’s The Masterpiece Does sexual morality play a role in our perception of reality? This contribution explores the rise of modernity as a radical change of perception. This is done by reading an 1886 novel on painting, Émile Zola’s L’Oeuvre (The Masterpiece). The Masterpiece is a novel that meticulously explores the relationship between reality and representation in which the genderism implications become clear. Zola comments implicitly on the paintings of Éduoard Manet, on which (...) naked women are depicted without any symbolism, which makes them ‘scandalous’. Contrary to Zola’s essayistic work on naturalism, the novel makes clear that the revolution of ‘naturalism’ in painting takes place within a gendered framework. The nakedness of the female model, which represented in the first half of the nineteenth century the highest ideal of beauty in a predominantly male culture, becomes the nakedness of reality, understood as a transgression of a gendered moral order. In The Masterpiece, painting comes to nothing, depicted by the suicide of the painter who fails to create his masterpiece. In doing so, Zola bids farewell to his initial enthusiasm for Manet’s work, and in the form of a novel he describes the ultimate consequence of naturalism, namely that ever-changing life cannot be depicted at all. In this article, The Masterpiece is interpreted as an ‘iconoclastic’ novel, in which the real protagonist is Christine, who resists Claude’s gaze fixed on her as a model. In doing so, Zola creates a triumph of literary naturalism over painting, but does not get beyond an essentialist genderism; the difference between man (representation of reality) and woman (presence of real life). The error is the real cause of the misery of man. This is the main thesis of Malebranche’s Magnum Opus The Research of Truth. In this paper the Cartesian background of this thesis is examined. I demonstrate that Malebranche translates Descartes’s idea of the error to a theological level, where it is called the fall. After a survey of the ideas of the error according to Descartes and the fall according to Malebranche, I compare the two thinkers on the theme’s (...) of the suspension of prejudices, the unreliability of the senses, scepticism, in which their vision’s agree, and the theme’s of the lumen naturale and the idea of God, in which their vision’s differ. In a concluding part I examine the Cartesian/Malebranchistic solution for the state of man in the fall, which unveils the philosophical structure of the religious conversion. (shrink)

In a recent article published in this journal (van Deemter, Gatt, van der Sluis, & Power, 2012), the authors criticize the Incremental Algorithm (a well-known algorithm for the generation of referring expressions due to Dale & Reiter, 1995, also in this journal) because of its strong reliance on a pre-determined, domain-dependent Preference Order. The authors argue that there are potentially many different Preference Orders that could be considered, while often no evidence is available to determine which is a good one. (...) In this brief note, however, we suggest (based on a learning curve experiment) that finding a Preference Order for a new domain may not be so difficult after all, as long as one has access to a handful of human-produced descriptions collected in a semantically transparent way. We argue that this is due to the fact that it is both more important and less difficult to get a good ordering of the head than of the tail of a Preference Order. (shrink)
